These General Terms and Conditions of Sale (hereinafter, "Terms of Sale") govern the contractual relationship between Mónica Conde Martinez (hereinafter, "the Artist" or "the Seller") and any user (hereinafter, "the Customer") who makes a purchase through the website www.MonicaConde.com (hereinafter, "the Website").

Placing an order on the Website implies the express and unreserved acceptance by the Customer of each and every one of these Terms of Sale.

 

Article 1: Seller Identification

  • Business Activity: Online sale of original artworks and high-quality reproductions.

 

Article 2: Purchase Process

 

The Customer can place an order by following these steps:

  1. Selection: The Customer will select the original artwork or reproduction they wish to purchase and add it to the "Cart".

  2. Cart: The Customer can review the order summary, modify it, or proceed to payment.

  3. Checkout: The Customer must fill out the form with their personal details, shipping address, and billing address.

  4. Shipping: The Customer will select the shipping method and see the associated cost.

  5. Payment: The Customer will select the payment method and complete the transaction.

  6. Confirmation: Once payment is finalized, the Customer will receive an automatic order confirmation email, which will serve as proof of the transaction.

The Seller reserves the right to reject an order if there are indications of fraud or if the payment information cannot be verified.

 

Article 3: Prices and Taxes

 

  1. Currency: All prices are displayed in Euros (€).

  2. VAT Included: In compliance with Spanish regulations, all prices shown on the Website for Customers within the European Union include the corresponding Value Added Tax (VAT).

  3. Shipping Costs: Shipping costs are not included in the product price. They will be detailed and added during the checkout process, once the Customer enters the delivery address.

  4. Customs and Duties: For shipments to the Canary Islands, Ceuta, and Melilla, the prices shown do not include local taxes (IGIC/IPSI) or customs clearance fees, which shall be borne entirely by the Customer upon receipt of the order.

 

Article 4: Payment Methods

 

Payment for the order will be made at the time of purchase. The accepted payment method is:

  • Credit or debit card (via Shopify Payments): The Customer may use Visa, Mastercard, or American Express. The transaction is carried out through a secure payment gateway (SSL), and the Seller does not store or have access to the Customer's banking data.

 

Article 5: Shipping and Delivery

 

  1. Shipping Area: Currently, shipments are made to Spain (Peninsula and Balearic Islands) and the rest of the European Union (EU) countries.

  2. Shipping Costs: A fixed shipping cost will apply for Spain and a different fixed cost for the rest of the EU. These amounts will be clearly indicated during the purchase process before payment confirmation.

  3. Delivery Timeframe: The maximum total delivery period (including packaging preparation and transport transit) will be 30 calendar days from the order confirmation date. Although the Seller will endeavor to keep delivery times as short as possible, this is the maximum guaranteed period.

  4. Receiving the Order: It is the Customer's responsibility to check the condition of the package at the time of delivery by the courier. If the packaging shows obvious damage (dents, tears, moisture), the Customer must note this on the courier's delivery note (e.g., "Package damaged, pending review") and notify the Seller within 24 hours at info@MonicaConde.com.

 

Article 6: Right of Withdrawal (Returns)

 

The Customer has a period of 14 calendar days, starting from the day they received the product, to exercise their right of withdrawal (return the product without justification).

  1. Application: This right applies to both original artworks and reproductions, given that the latter are offered in standard, non-customized sizes and finishes.

  2. Notification: To exercise this right, the Customer must notify the Seller of their decision unequivocally via email at info@MonicaConde.com.

  3. Return Costs: In the event of withdrawal, the Customer shall bear the direct costs of returning the product (shipping and transport costs back to the Seller's studio).

  4. Refund: The Seller will refund the Customer the full amount of the product, including the original shipping costs (from the initial shipment), within a maximum period of 14 calendar days from receiving the returned product.

  5. Conditions: The product must be returned in perfect condition, unused, with its original packaging, and with all certificates (COA) that accompanied it. If the returned product shows damage or signs of use, the Seller may apply a reduction in the amount to be refunded.

 

Article 7: Legal Guarantee

All products sold on the Website (both originals and reproductions) are covered by the 3-year legal guarantee against "lack of conformity," in accordance with Spanish legislation (Royal Legislative Decree 1/2007).

This guarantee covers manufacturing defects or damage that occurred before delivery (e.g., a printing defect on a reproduction, a frame that arrives broken due to a manufacturing fault). It does not cover natural wear and tear, damage from misuse, improper exposure to sunlight, or humidity by the Customer.

 

Article 8: Special Conditions: Artworks and Intellectual Property

 

  1. Original Artworks: All original works (oil paintings) are unique pieces. They are delivered signed by the Artist and accompanied by a physical, signed Certificate of Authenticity (COA) that attests to their authorship and uniqueness.

  2. Reproductions (Giclée Prints): All reproductions are high-quality Giclée prints in limited series. Each reproduction is delivered signed, numbered (indicating the series limit), and accompanied by its corresponding Certificate of Authenticity (COA).

  3. Intellectual Property: The Seller expressly informs that the purchase of an original artwork or a reproduction does NOT transfer the intellectual property, exploitation, or reproduction rights thereof. Mónica Conde Martinez retains all copyright over her works. The reproduction, distribution, or public communication of the purchased work is prohibited without the express written consent of the Artist.

Article 10: Applicable Law and Jurisdiction

These Terms of Sale are governed by Spanish legislation. In the event of a conflict or dispute, the parties submit to the jurisdiction of the courts of the Customer's domicile (as a consumer) or, alternatively, to the courts of the city of Girona (Spain).
